Conditions d’utilisation
Last updated: 11 October 2026
This is a translation. If the English and German versions differ, the German version applies.
1. What this covers and who we are
These Terms of Service apply to your use of Lumenwerk: the web app with its video editing tools, the AI features (including Lumi) and everything that comes with it. Your contract is with:
Tian Xun Chai
Chai Digital (Lumenwerk)
Uhlandstraße 31, 01069 Dresden, Deutschland
support@lumenwerk.com
How we handle your data is explained in the privacy policy. When you get credits back for an AI job is covered by the Credits Refund Policy. Both are part of this agreement. Terms of your own only apply if we expressly agree to them.
2. Your account
- You must be at least 13 years old to create an account.
- If you are under 18, you may only take out a paid plan with the consent of your parent or legal guardian.
- An account belongs to exactly one person. Do not share your access, and do not create several accounts to get around credits or limits.
- Your details must be accurate. If your email address changes, update it.
- You sign in with a code sent by email, or with Google or Apple. Keep your inbox and those accounts secure. If you notice someone else using your account, tell us right away.
You can have your account deleted at any time, in your account settings or by writing to support@lumenwerk.com.
3. Beta
Lumenwerk is in beta. That means: we charge nothing during the beta. Features may change, be added or be removed, and there may be bugs. We aim for stable operation but do not guarantee any particular availability, so also keep important projects as an export.
Before we start charging, we will tell you in good time. A paid plan only starts if you take it out yourself.
4. Plans, credits and prices
There is a free plan and paid plans, billed monthly or yearly. Each plan includes a set number of credits every month. AI jobs cost credits; the price is shown in the app before every job. Chats with Lumi and the local tools cost no credits; chats have a fair-use cap per plan.
- Plans, credits and prices are listed on the pricing page. The prices there are provisional until the beta ends.
- Credits are valid for one billing month. Credits you do not use expire at the end of the month, unless your plan includes a carry-over as shown on the pricing page.
- Credits are not money. They are not paid out, earn no interest and cannot be transferred to other accounts.
- If an AI job fails, you get its credits back automatically. For results that work but miss the mark, the Credits Refund Policy applies.
Later, payments will be handled by a payment provider acting as reseller (merchant of record). We will name the provider here before we charge anything. It will then also issue your invoices and handle VAT.
5. Term and cancellation
Paid plans run for one month or one year and renew automatically for the same period unless you cancel. You can cancel at any time, effective at the end of the current period, simply with the cancel button in your account. Until then you keep full access; afterwards you move to the free plan.
You can end the free plan at any time by deleting your account.
6. Right of withdrawal for consumers
If you are a consumer, you can withdraw from a paid contract within 14 days without giving a reason. The period starts when the contract is concluded. A clear message to support@lumenwerk.com is enough.
Lumenwerk is a digital service. If you want to use it right away, we ask at checkout for your express consent that we start before the withdrawal period ends, and for your acknowledgement that your right of withdrawal expires once the service has been fully provided. If you withdraw after we have started, you pay an amount proportionate to what was provided until then. You receive the full withdrawal notice and the model withdrawal form at checkout.
7. Your footage and videos
Your video stays with you. The video file is opened and processed in your browser and never uploaded to us. Only when you use a feature that needs it do the audio track, text (such as the transcript or chat) and individual still frames go to the AI providers named in the privacy policy.
You keep all rights to your material. You only allow us what is needed to carry out your jobs: storing and processing those parts and passing them to those providers. Nothing more. We do not use your material for advertising and do not sell it.
Only use material you have the necessary rights to, and respect the rights of the people in it (such as their right to their own image).
8. AI results
What the AI creates for you (cuts, subtitles, titles, graphics, plans) belongs to you, as far as the law allows. We claim no rights to it. Note that purely machine-generated content is not protected by copyright in every country.
AI makes mistakes. Transcripts can be wrong, cuts can remove something important, texts can get facts wrong. We do not guarantee that results are correct, complete or fit for your purpose. Check them before you publish. You are responsible for what you publish.
9. Fair use
When using Lumenwerk, you may not:
- edit or create illegal content, such as hate speech, depictions of violence against children, or content that threatens or exposes others,
- use material that infringes other people’s copyright, trademarks or personality rights,
- abuse the AI, for example to create deceptive content about real people or to trick its safeguards,
- get around credits, limits or payment, for example with several accounts, automated requests or tampering with the app,
- reverse engineer the service, use its interfaces outside the app or overload it, unless the law expressly allows it.
If you publish a style in the community catalogue, you are responsible for it and need the rights to everything it contains. Other users may then use it in their videos. We may remove public styles that break these terms or the rights of others.
10. Content we provide
Lumenwerk includes sound effects, fonts, styles, templates and other content. You may use them in your own videos, including when you publish them, while your account exists, and for videos made during that time also afterwards. You may not pass them on or sell them on their own, for example as your own sound or template collection. Some content may come with special conditions, such as attribution; the app points this out.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
For slight negligence we are only liable if we breach an essential contractual obligation, meaning one whose fulfilment makes the contract possible in the first place and on which you may rely. Our liability is then limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded.
On the free plan and during the free beta, we are only liable for intent and gross negligence and in the cases of the first paragraph. For loss of data we are only liable to the extent that would have occurred had you backed up regularly.
12. If we suspend or end an account
If someone seriously breaches these terms, we may remove content, restrict features or suspend the account. We will tell you first and hear you out, unless it is urgent. We may end the free plan with 30 days’ notice. Either side may end any contract without notice for good cause. We refund paid, unused periods pro rata, unless the termination is due to your breach.
13. Changes to these terms
We may change these terms, for example when new features arrive or the law changes. We will email you the changes at least six weeks in advance. You can object until they take effect or cancel your plan. If you do not object, the new terms apply; we will point this out expressly in the email. We will not change essential parts of the contract this way, such as the price and scope of your plan.
We store which version of these terms you accepted, and when.
14. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Final provisions
If any provision of these terms is invalid, the rest remain valid. The statutory rules apply in place of the invalid provision. Questions about these terms? Write to us at support@lumenwerk.com.
